These general terms and conditions concern the use of the website www.aegeanvt.com,  (hereinafter the “Website”), owned by the company with the corporate name “VirtualWorks”. In these terms and conditions, “we” “us” and “our” refers to VirtualWorks LP.

The use of this website is subject to the following terms and conditions. These terms and conditions govern your access to and use of the Website. By using the Website, its content and the services offered, you, the user of the Website, unconditionally declare and assure that you understand and agree with the content of the Terms of Use. If you do not agree with the content of the Terms of Use in whole or in part, please do not use the Website and the services offered through the Website.

1. This Website is operated by us.
2. We reserve the rights to change these Terms and Conditions at any time by posting changes online. Continued use of this site after changes are posted constitutes your acceptance of this agreement as modified.
3. These terms and conditions shall be governed and construed in accordance with European and Greek laws. Any disputes shall be subject to the exclusive jurisdiction of the Greek Courts.
4. You agree to use this Website only for lawful purposes, and in a manner which does not infringe the rights, restrict, or inhibit the use and enjoyment of the Website by any third party. Users of our interactive features which will be available shortly should also refer to our terms of use and participants’ rules.
5. You are prohibited from using the Website to harm others or their rights in any way, including their intellectual and industrial property rights and personal data. You are prohibited from destroying, deactivating, overloading, or causing damage to the Website, using non-authorized means for amending the content of the Website or intervening in its operation in any way. In case you have access to other websites via the Website, it is presumed irrefutable that VirtualWorks has no liability for the content and in general for anything associated with these websites. In any case, you, the user, unconditionally acknowledge and accept that you are exclusively liable for any damage or breakdown caused to the Website and to third parties, irrespective of the specific cause or its type, as a result of any breach by you, directly or indirectly, of any term of the Terms of Use.
6. The use of the Website and its services requires that you, the user, are 18 years old, you have legal capacity and in case you use the Website’s services on behalf of another person, you declare and guarantee that you have their authorisation and consent.

The Website is a virtual online platform that presents landscapes of the Aegean islands through 360̊ photos and provides travelers with useful information about accommodation, travel agencies, transportation companies, travel guides, restaurants, bars, cafes, museums, attractions, archaeological sites and other travel-related products. VirtualWorks does not offer services or sell products itself.
8. The Website is a virtual online platform in which tourism and travel related products and services are promoted. Specifically, through the Website, services, products and promotions of third parties are provided to you (hereinafter, the term “Service Providers” includes third parties that provide any kind of products, services or advertising related to travel and tourism sector and contractually linked with VirtualWorks).
9. When you proceed to an order or purchase a product or service, and generally when you make a transaction through the Website (either within the Website environment or on third party websites), you are entering into a contract directly with the Service Provider.
10. All information published on the website relating to the Service Providers is provided directly by them. The Service Providers are solely responsible for the correctness, completeness, and accuracy of this information (e.g., prices, fees, and other payments for the provision of their services, availability, cancellation policies, and generally the conditions under which they provide their services). This information is not controlled by VirtualWorks as the service providers themselves publish their information on the site via the extranet. VirtualWorks neither guarantees nor confirms the accuracy, completeness, or validity of said information, nor is it liable towards you, the user, for any reason related to the contractual relationship between you and the Service Provider (including, among others, false information, service non-availability, cancellation of the service, etc.).
11. VirtualWorks does not accept, approve, recommend, or suggest to you any of the Service Providers and their services/products through the Website, unless otherwise and explicitly stated.
12. The Website provides access to other websites, administered and owned by third parties. Liable for these websites and their content are the companies that own these websites (Service Providers included). VirtualWorks has no right to intervene in the content of the previously mentioned websites nor assumes any liability for their content, or the correctness, completeness and accuracy of the information provided through these websites.
13. VirtualWorks has no liability (contractual or for tort) in case of non-performance, poor performance, and in general any liability for any reason whatsoever associated with the provision of the services or the sale of products of Service Providers, given that the said services and products are not provided or sold by VirtualWorks.
14. These Terms & Conditions set out the full extent of VirtualWorks ‘s obligations and liabilities in respect of the promotional services offered through the Website, unless as agreed otherwise in specific terms of use. The content and services of the Website are provided on an “as is” basis, without any guarantee, expressed or implied, by VirtualWorks by any means.
15. With the explicit reservation of its rights, VirtualWorks does not guarantee, assumes no liability (civil or penal) and/or obligation, unless if otherwise stated in the Terms of Use, for any damage that might occur to the user caused by the use of the Website and/or the provision of the services by Service Providers (indicatively in case of non-appropriateness, non-availability, non-adequacy, non-safety of the products/services of Service Providers).
16. VirtualWorks, to the maximum extent provided by law, assumes no liability under all circumstances and in any case (negligence included) for any damage that may occur to the user or any third party (both material and non-material, direct or indirect or of any other type and for any cause):
17. The users are exclusively and solely liable for all the transactions made through or as a consequence of the use of the Website, as well as for the specific terms and conditions of the said transactions.
18. To the maximum extent permitted by law, VirtualWorks’ liability towards the user or any third party for compensation for any claim (tort included) is excluded.
19. You agree to indemnify, defend and hold the Website harmless from any liability, loss, damages, claim, or expense related to your violation of these Terms of Use and in case which causes to Website the above mentioned.
20. You explicitly agree and accept that the Service Provider assumes the exclusive liability towards you regarding the provision by the Service Provider to you of services through the Website, given that VirtualWorks is not a seller or a reseller of any Service Provider’s service or product. For any complaint or claim you might have against the Service Provider, you shall address directly the Service Provider, with whom you have a contractual relationship.

The Website and the information, names, images, pictures, logos regarding or relating to us are provided “as is” without any representation or endorsement made and without warranty of any kind whether express or implied. In no event will we be liable for any damages including, without limitation, indirect or consequential damages, or any damages whatsoever arising from the use or in connection with such use or loss of use of the Website, whether in contract or in negligence.

We are not providing professional advice and you should obtain professional or specialist advice that is appropriate to your circumstances and we give no warranty and accept no liability should you use the information without obtaining independent advice.

VirtualWorks assumes no liability in any case whatsoever for the availability, the content, the privacy and cookie policies, and the quality or the correctness of the webpages and functions of third party’s websites, which are available to the user through hyperlinks, links or banners. Therefore, in case any problem occurs during the visit or use of such pages/functions, the user shall immediately communicate with the said websites.

The user explicitly and undeniably accepts that VirtualWorks has no liability (irrespective of the specific cause or its type) for any loss or damage they might have suffered as a result of non-availability of the aforementioned websites or sources, or as a result of any confidence shown by the user to the completeness, accuracy or existence of any advertisement of any product marketed through the aforementioned websites. We strongly recommend that you carefully read the terms of use and privacy and cookie policy of the aforementioned websites and keep a copy of them.
28. Where the Website contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from you using  them. When accessing a site via our Website we advise you to check their terms of use and privacy policies to ensure compliance and determine how they may use your information.
29. When you visit our Website, we give you a limited license to access and use our information for personal use.
30. We update the Website regularly, and may change the content at any time. It is our right to suspend access to our site, or close it indefinitely. If any of the material or information on our site is out of date, we are under no obligation to update such material.

39. VirtualWorks is the creator and legal owner of all 360° panoramic view photos contained in the Website and Aegean Virtual Tours, at all times, throughout the world.
40. VirtualWorks is the creator and legal owner of all Aegean virtual tours, the Website logo and virtual tour template design.
41. Unless stated otherwise, the content of the Website, including intellectual property rights (industrial property rights and copyright), intangible assets, non-registered, photos, pictures, illustrations, graphic designs, texts, structure, etc., are VirtualWorks’ and/or third parties’ exclusive property and are protected by Greek law, EU law, and international treaties and agreements.
42. Consequently, you accept and understand that you do not have the right to use, copy, extract, re-utilise, sell, resell, distribute, download, upload and/or commercially exploit, present to the public in any way any content or parts of the content of the Website for any reason, unless you have prior written consent of VirtualWorks, of the third party, of the owner or licensee.
43. If you believe your intellectual property rights have been infringed by our website content, please contact us by email.
44. All trade marks, brands and logos generally identified either with the symbols TM or ® which are used on this Website are either owned by us or we have a license to use them. Your access to our Website does not license you to use those marks in any commercial way without our prior written permission.

Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged. The license also does not permit you to meta tag or mirror our Website without our prior written permission. We reserve the right to serve you with notice if we become aware of your meta tagging or mirroring of our website.

The Terms of Use, any amendments of the Terms of Use as well as all issues associated with the Website and the services provided by VirtualWorks (also through the Website) are subject to Greek law. Any dispute arising from these Terms of Use and the Website will be submitted to the Courts of the City of Athens, which have exclusive competency over any other venue. The exclusive jurisdiction of Athens Courts includes interim measures, temporary restraint orders, and disputes arising from tort.
50. If any of these provisions cannot be applied for whatever reason or is against the law, this shall not affect the validity of the remaining provisions of the Τerms of Use.
51. The Terms of Use are provided in Greek and English. In case of discrepancies, the Greek version shall prevail.
52. VirtualWorks’s delay to enforce any of its rights or to exercise any right, shall not be considered as a right waiver in any case
53. Any comment, feedback, idea or suggestion (called “Comments”) which you provide to us through this Website becomes our property. If in future we use your comments in promoting our Website or in any other way, we will not be liable for any similarities which may appear from such use. Furthermore, you agree that we are entitled to use your comments for any commercial or non-commercial purpose without compensation to you or to any other person who has transmitted your comments.

The content of any comments published by you on the Website must be true, accurate and lawful and compliant with all applicable laws and must not infringe any right of VirtualWorks or of any third party.
